Medicine For Our Military Event

Medicine For Our Military is an outreach center Shasta County whose purpose is to assist and serve Veterans in a variety of ways. They provides rides to and from appointments, aid in vehicle and home repair, offer hot meals to Veterans that need it, and also provide medical marijauna to Veterans with valid prescriptions.
However, on June 3rd, their garden was raided by the Shasta County Sheriff’s Office. Please come to this free event to learn more about the organization and legal troubles they are currently facing.

Recently, a client of ours was facing multiple charges including possession of a controlled substance with a firearm, which is a prison eligible felony. Additionally, the DA in the case was looking to add more prison eligible felonies such as bringing a controlled substance into a jail. Eric Alan Berg & Associates was able to negotiate an agreement with the DA where our client plead to only two misdemeanor charges of possession of a firearm and controlled substance.

Before retaining us, our client had a number of pending cases, and some matters being investigated by law enforcement. They took a plea bargain in which they plead guilty to three of their pending cases, with the understanding that the rest of their pending cases would be dismissed and any un-filed cases would not be filed. Shortly after entering this agreement, the DA’s office filed charges related to an investigation that began before they entered the agreement. We successfully argued that the DA’s office breached the plea agreement, and had the plea agreement enforced – meaning the new case was dismissed. False accusation, case

False accusation, rights violation: About a month ago, Berg & Associates represented a man accused of a felony for giving two pounds of pot butter to a friend. The authorities lied in the police report and claimed that the man accused had confessed to the crime. Mr. Berg demanded an actual copy of the tape recording of his clients statements. When Mr. Berg finally got that tape recording, it showed that the officer lied in his report about the confession. The tape also showed that the officer never read the accused his miranda rights and interviewed him even after he had demanded an attorney. For these reasons, Mr. Berg filed a motion to suppress the evidence against his client and the prosecutor promptly dismissed the case.

Medical Marijuana in the home case: A few weeks ago, Berg & Associates defended a father and son accused of cultivating marijuana for sale. The client cultivated for personal use of marijuana as a medicine. The sheriff had searched their home without a warrant and interrogated him. The defense moved to suppress and throw out the evidence against them because the sheriff had searched their home without a warrant in violation of their 4th amendment rights. The prosecutors looked at the defense motion and dismissed all the charges against the father and son.

In the case that garnered national media attention, local Chico attorneys, Scott Wippert and Robyn Bramson achieved great results in defending Brandon Mclinerny, the 17 year old accused of shooting and killing his classmate in 2008. The Ventura County District Attorney’s Office charged, the then 14 year old Brandon as an adult. After 36 days of testimony and deliberating for a little more than 15 hours, the jury was split 7 to 5 in favor of voluntary manslaughter resulting in a mistrial.

June 22, 2011 Redding California, A jury of 12 found Ryan Hickman, Not Guilty of 37 felony counts. Mr. Hickman was arrested in August 2009. On may 10, 2011, A jury found Jason Grove Not Guilty of 2 counts of felony death threats. After a 3 month trial, verdicts were reached in Jason Grove’s case. Jason had been accused of stalking, felony threats, and spouse abuse. He was exposed to 14 years in prison because of past history. This case was personally handled by Mr. Eric Alan Berg, his chief investagor Doug Manning and his A legal defense team.
