Being arrested without charges can be confusing and stressful. Many people are released after an arrest
without a court date or paperwork, leaving them unsure of what happens next.
An arrest does not mean charges have been filed. After an arrest, the case is reviewed by the
District Attorney, who decides whether to file charges, request additional investigation, or reject the case.
This process can take days, weeks, or longer depending on the circumstances.
California law sets deadlines for filing charges. Many misdemeanors must be filed within one year, while most
felonies have longer filing periods. Some serious offenses have no statute of limitations.
In some cases, law enforcement may contact you again, or you may not receive notice until charges are filed.
Staying informed about your situation after an arrest is important.
